Terms of Use

1. Eligibility

You must be at least 18 years old to create an account or post listings on ListGarum. By using the Services you represent and warrant that you meet this requirement and that you have the legal capacity to enter into a binding agreement.

2. Your account

• You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account.
• You must provide accurate and complete registration information and keep it up to date.
• You must notify us immediately at support@listgarum.com.np if you suspect any unauthorised use of your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

3. Posting listings

When you post a listing you agree that:

• All information is accurate, truthful, and not misleading.
• You own, or have the right to sell, the item or service listed.
• The listing does not infringe any third-party intellectual property rights.
• The item or service is legal to sell in Nepal.
• You will honour the price and conditions stated in your listing.
• You will promptly mark or remove listings when items are sold or no longer available.

4. Prohibited content and conduct

You may not use ListGarum to post, share, or facilitate:

• Illegal goods or services (weapons, controlled substances, counterfeit items, etc.).
• Adult content, pornography, or sexually explicit material.
• Content that is hateful, threatening, harassing, defamatory, or discriminatory.
• Spam, unsolicited advertising, or pyramid schemes.
• Phishing, malware, or any content designed to deceive or harm other users.
• Content that violates the privacy or personal data of any individual.
• Duplicate or misleading listings created to manipulate search results.
• Any activity that interferes with or disrupts the platform or its servers.

We reserve the right to remove any content and suspend or terminate any account that violates these prohibitions, without prior notice.

5. Transactions between users

ListGarum is a venue that connects buyers and sellers. We are not a party to any transaction between users. We do not own, inspect, guarantee, or take responsibility for any item listed. All transactions are solely between the buyer and seller. We strongly recommend:

• Meeting in a safe, public place for in-person exchanges.
• Inspecting items carefully before making payment.
• Not sending money in advance to unknown parties.
• Reporting suspicious listings to us immediately.

6. Intellectual property

All content on ListGarum - including the logo, design, text, graphics, and software - is owned by or licensed to ListGarum and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

By posting content (listings, photos, reviews) on our platform, you grant ListGarum a non-exclusive, royalty-free, worldwide licence to display, reproduce, and distribute that content solely for the purpose of operating the Services.

7. Disclaimer of warranties

The Services are provided “as is” and “as available” without any warranties of any kind, either express or implied. We do not warrant that the platform will be uninterrupted, error-free, or free of viruses or other harmful components. We make no warranties regarding the accuracy, completeness, or reliability of any listing content.

8. Limitation of liability

To the maximum extent permitted by applicable law, ListGarum and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Services, including but not limited to loss of profits, data, or goodwill, even if we have been advised of the possibility of such damages.

Our total liability for any claim arising from these Terms or use of the Services shall not exceed the amount you paid to ListGarum (if any) in the 12 months preceding the claim.

9. Indemnification

You agree to defend, indemnify, and hold harmless ListGarum from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the Services, your listings, or your violation of these Terms.

10. Modifications to the Services and Terms

We reserve the right to modify, suspend, or discontinue any part of the Services at any time. We may also update these Terms at any time. We will notify registered users of material changes via email or a prominent notice on the platform at least 14 days before changes take effect. Your continued use of ListGarum after the effective date constitutes acceptance of the revised Terms.

11. Governing law

These Terms are governed by and construed in accordance with the laws of Nepal. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Nepal.
